Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and Tripbuds Pty Ltd (ABN 88 635 938 537), a company registered in New South Wales, Australia, with its registered office at 100 Harris Street, Pyrmont NSW 2009 ("Tripbuds", "we", "us", "our"). They govern your use of the Tripbuds mobile app and the website at tripbuds.com (together, the "Service").

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 17 years old to use the Service. By using the Service, you confirm that you meet this age requirement and that you have the legal capacity to enter into these Terms.

4. Your content

You own what you create. Trip plans, messages, photos, notes, and other content you post on the Service ("Your Content") remain yours.

You grant Tripbuds a worldwide, non-exclusive, royalty-free licence to host, store, copy, display, and transmit Your Content solely to provide the Service to you and the crew members you invite. This licence ends when you delete Your Content or your account, except where retention is required by law or for legitimate backup purposes (see our Privacy Policy).

You are responsible for Your Content. You confirm that you have the right to post it and that doing so does not breach any law or third-party right.

We do not use Your Content to train AI models, and our AI providers are contractually prohibited from doing so. See our Privacy Policy for details.

Tripbuds offers AI-assisted features (for example, generating a draft itinerary from a brief you provide). You understand that:

6. Crew trips and shared content

When you invite people to a trip, content within that trip becomes visible to crew members. You are responsible for the people you invite. The crew owner can remove members and delete trip content. If a member is removed, they lose access immediately, but copies they have downloaded or screenshotted may remain outside our control.

7. Bookings and affiliate links

Tripbuds is a planning tool, not a booking agent or a travel agent. We do not sell flights, hotels, tours, transfers, insurance, or any other travel product. When you tap a booking link in the app, you leave Tripbuds and complete the booking directly with a third-party provider (for example, Booking.com).

Affiliate disclosure: Some of our links are affiliate links. When you book through them, the provider may pay us a commission at no extra cost to you. Affiliate relationships never influence what we recommend or how items are ranked in your itinerary. This is consistent with the Australian Competition and Consumer Commission (ACCC) influencer and endorsement guidelines.

Your booking is governed entirely by the third-party provider's terms and privacy policy. Tripbuds is not a party to your booking and has no responsibility for:

8. Intellectual property

The Service, including all software, design, text, graphics, logos, the name "Tripbuds", and the Tripbuds mark, is owned by Tripbuds Pty Ltd or its licensors and is protected by Australian and international copyright, trademark, and other laws.

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal, non-commercial use, subject to these Terms.

9. Beta and in-development features

Tripbuds is in active development. Some features are labelled beta, preview, or experimental. They may change, break, or be removed at any time without notice. We make no guarantees about the availability or reliability of any feature.

10. Fees

The Service is currently free to use. If we introduce paid features in the future, we will give you clear notice and you will not be charged unless you affirmatively opt in. Existing free features will not be removed and put behind a paywall without at least 30 days' notice.

11. Third-party services

The Service integrates with third-party services (for example, Google Places, Apple Push Notification service, Booking.com via CJ Affiliate). Your use of those services is governed by their own terms. We are not responsible for their content, availability, or practices.

12. Suspension and termination

You can stop using the Service at any time and can delete your account from Settings → Delete account. We may suspend or terminate your access if:

On termination, your right to use the Service ends. Provisions that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, governing law) will continue to apply.

13. Australian Consumer Law

If you are a consumer in Australia, you have guarantees under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot be excluded. Nothing in these Terms limits or excludes those rights. To the extent permitted by law, our liability for breach of a consumer guarantee in respect of services is limited to re-supplying the services or paying the cost of having them re-supplied.

To the maximum extent permitted by law, the Service is provided "as is" and "as available". We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses. We do not warrant the accuracy, completeness, or reliability of any information shown in the Service, including third-party content (place details, prices, opening hours, ratings, photos).

15. Limitation of liability

To the maximum extent permitted by law (and subject to clause 13 above), Tripbuds will not be liable for:

Our total aggregate liability to you for all claims arising out of or related to the Service is limited to the greater of (a) the amount you have paid us in the 12 months preceding the event giving rise to the claim, or (b) AUD $100.

You agree to indemnify and hold harmless Tripbuds Pty Ltd, its officers, employees, and contractors from any claim, loss, or damage (including reasonable legal costs) arising from (a) your breach of these Terms, (b) Your Content, or (c) your misuse of the Service.

17. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you in the app and by email at least 14 days before they take effect. Your continued use of the Service after that date means you accept the updated Terms.

18. Governing law and disputes

These Terms are governed by the laws of New South Wales, Australia. You and Tripbuds submit to the exclusive jurisdiction of the courts of New South Wales and the federal courts of Australia sitting in Sydney, except where Australian Consumer Law gives you a right to bring proceedings in another forum.

If you download Tripbuds from the Apple App Store or Google Play, your use is also subject to those platforms' standard end-user licence terms. In the case of the Apple App Store, Apple is a third-party beneficiary of these Terms and may enforce them against you. Apple is not responsible for the Service or any claims relating to it.
